Terms of service

These terms are between Smart Office Automations, Amritsar, Punjab, India (“GymKaro”, “we”) and the gym that uses GymKaro (“you”). By using GymKaro you agree to them.
1. The service
GymKaro is online software to manage a gym's members, renewals, payments, reminders, attendance and related features. Features depend on your plan. We may improve or change features over time.
2. Accounts
- The gym owner is responsible for all activity under the gym's owner and staff logins, and for keeping passwords private.
- Give correct details when signing up and keep your contact details up to date.
3. Plans, payment and renewal
- New gyms get a free trial. After that, the plan is paid monthly or yearly in advance, at the prices shown in the app.
- Reminders are sent before the plan ends. After it ends there is a 5-day grace period; then the app is paused until renewal. Your data is not deleted when the app is paused.
- Payments are not refundable for a period already started. Prices may change with at least 30 days' notice; the new price applies from your next renewal.
- Prices are inclusive of applicable taxes unless stated otherwise.
4. Your members' data
- The data you enter belongs to you. You can download it any time (Settings → Backup).
- You are the Data Fiduciary for your members' personal data under the DPDP Act, 2023. You must take your members' consent (a parent's or guardian's for members under 18), use the data only for running your gym, and answer their requests to see, correct or delete it.
- We process that data only on your behalf, as described in our Privacy policy.
5. Fair use
Do not use GymKaro to send spam, to message people who have not agreed to hear from your gym, for anything illegal, or to try to access another gym's data. WhatsApp and Telegram messages must follow those services' own rules. We may suspend an account that breaks these terms.
6. Availability
We work to keep GymKaro running all the time, but it is provided “as is” and there may be short breaks for maintenance or because of our providers. Keep your own backup of important records.
7. Liability
To the extent the law allows, GymKaro is not liable for indirect losses such as lost profits or lost business. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim.
8. Ending the service
You can stop using GymKaro at any time. Download your data first; we delete it as described in the Privacy policy. We may end the service for a gym with 30 days' notice, or immediately for a serious breach of these terms.
9. Law and disputes
These terms are governed by the laws of India. Courts at Amritsar, Punjab have jurisdiction.
